THE GURUGRAM OWNERSHIP STORY

Gurugram's NRI Property Ownership Profile

Gurugram's emergence as an IT/ITES and corporate hub encouraged many Indian professionals to purchase homes in DLF City, Golf Course Road and HSVP sectors before relocating to the USA, UK, Canada, Singapore, Australia and the Middle East.

Owners of properties acquired during the 2000–2010 period may now be considering high-value resale transactions. For an NRI Gurugram property seller, the key challenge is not simply finding a buyer, but managing capital gains, non-resident TDS and property valuation before registration.

01

High-Value Property Transactions

DLF City Phase 1–3 flats, Golf Course Road residences and HSVP sector houses may involve substantial sale consideration, making the amount withheld as TDS particularly important.

02

Section 195 TDS Exposure

When an NRI sells immovable property in India, the buyer generally needs to consider Section 195 withholding obligations. The applicable deduction depends on the chargeable income, tax provisions and available certificates.

03

Complex Capital Gains Position

Residential status, acquisition date, inherited-property cost, holding period, fair market value and applicable tax rules can materially influence the seller's tax calculation.

The Section 197 LDC for NRI Gurugram Sellers

A Section 197 Lower Deduction Certificate (LDC) may allow eligible NRI sellers to have tax deducted at a lower rate, or at nil where authorised, rather than facing withholding that exceeds their estimated Indian tax liability. The certificate must be obtained from the appropriate Income Tax authority.

ILLUSTRATIVE CASE STUDY

Canadian NRI Selling an Inherited DLF Phase 2 Flat

A hypothetical transaction demonstrating why historic property valuation can matter.

Property DLF City Phase 2 3-BHK · 1,650 sq. ft. super area
Illustrative Sale Price ₹2.50 Crore Assumed sale in 2026
Illustrative Historic FMV ₹42 Lakh Assumed value as of 1 April 2001
Valuation Focus Section 55(2)(b) Subject to statutory eligibility
Important: These figures are hypothetical, not an actual valuation or approved tax computation. An inherited property's eligible cost basis, the 1 April 2001 FMV option, and the applicable tax regime must be verified individually.
01

Establish the Historic Property Value

Where legally applicable, obtain a 1 April 2001 FMV valuation supported by relevant DLF Phase 2 comparable transactions, property characteristics and market evidence. Any historic developer premium must be justified by evidence.

02

Determine the Applicable Tax Treatment

The seller's CA evaluates long-term capital gains, inherited-property cost, applicable indexation or transition provisions, surcharge and cess. The availability of alternative calculations depends on the taxpayer and transaction.

03

Apply for Section 197 LDC

Where eligible, the NRI or authorised representative applies for a Section 197 Lower Deduction Certificate through the prescribed Income Tax process, supported by the relevant tax computation and documentation.

04

Complete the Sale with Correct TDS

The buyer follows the valid certificate's conditions when deducting tax. This may reduce excess withholding and improve sale-proceeds liquidity, subject to the approved certificate.

₹

Why This Matters for High-Value Gurugram Sales

On a ₹2.5 crore property transaction, even a modest difference in the authorised TDS treatment can significantly affect funds available at closing. However, Section 197 is not a tax exemption or guaranteed saving; it changes withholding only as authorised.
