Answers to Common Gurugram Valuation Questions

Explore practical considerations before selling, buying, financing, or valuing property and industrial assets. Individual outcomes depend on the relevant documents, applicable law, market evidence, and the purpose of valuation.

01 My HSVP Sector 9 plot was allotted in 1992 and I plan to sell it for ₹1.9 crore. Could Section 55(2)(b) apply?

Section 55(2)(b) may be relevant if the property was acquired before 1 April 2001. Eligibility and the appropriate fair market value depend on the acquisition history, ownership documents, and the applicable capital-gains rules.

For an HSVP Sector 9 plot in Gurugram, a valuation exercise may examine historical comparable transactions, plot size, location, allotment and possession records, and other reliable evidence around the relevant valuation date. Historical values should be supported by verifiable records rather than assumed from a general range.

The choice of valuation method and any tax implications should be reviewed with your chartered accountant. Share your allotment date, possession documents, plot details, and proposed sale price for an initial discussion.

02 I own a DLF City Phase 3 flat. How can the DLF brand affect my valuation certificate?

A DLF City Phase 3 property valuation should consider relevant comparable transactions, the specific building and sector, property condition, area, amenities, lease or title considerations, and current market evidence.

Where reliable evidence supports a difference between comparable DLF and non-DLF properties, the valuer may explain that difference using a documented comparison. A brand-related premium should not be assumed at a fixed percentage without evidence specific to the property and valuation date.

An independent valuation report may help owners, buyers, and lenders understand the basis of an assessed value. The lending bank retains responsibility for its own credit decision and may require a separate valuation through its empanelled valuer.

03 My Dwarka Expressway flat is significantly delayed. Should I accept a settlement or approach H-RERA?

Before deciding, compare the property's current fair market value (FMV) and possession status with the potential financial outcomes of the remedies available under the applicable RERA framework. The right option depends on the agreement, project status, delay period, payments made, and your objectives.

For an OC-pending Dwarka Expressway flat, a valuation should clearly disclose the status of the occupation certificate and consider how that status affects marketability and comparable evidence.

Any proposed refund, interest, compensation, or possession remedy should be calculated and confirmed with a qualified legal adviser using the relevant documents and applicable orders. A valuation report can support the property-value component of your assessment, but it does not determine your legal entitlement or guarantee a particular H-RERA outcome.

04 I am an NRI living in the USA and own a DLF Golf Course Road flat. Do I need to travel to India to sell it?

An NRI property valuation can often be coordinated remotely, subject to site access, document availability, identification requirements, and the scope of the engagement. A local inspection may be arranged where required.

For a DLF Golf Course Road property, documents can often be shared digitally for preliminary review. The final process depends on the purpose of the valuation and the documents required for the report.

If the sale involves Indian capital gains tax or non-resident seller TDS, discuss the transaction with your chartered accountant. Section 195 withholding and a possible application under Section 197 depend on the facts and the applicable tax procedure; any withholding reduction requires the appropriate approval or certificate.

05 My Manesar CNC production lines are PPAP-certified for Maruti. Can this affect their bank valuation?

PPAP certification and customer approval history may be relevant to an industrial asset assessment, but they do not automatically establish a fixed percentage increase in equipment value.

For Manesar plant and machinery valuation, the assessment may consider the machine's make, model, age, condition, capacity, maintenance history, technological obsolescence, installation, remaining useful life, and available market or cost evidence. Relevant PPAP and customer-specific records can be reviewed as supporting documentation.

The valuation report should explain how the available evidence affects the adopted value and methodology. The bank or lender will determine whether the report meets its own requirements for collateral assessment.

06 I own an office unit in DLF Cyber City. Can I mortgage it to finance business expansion?

A DLF Cyber City commercial property may be considered as collateral, subject to the lender's eligibility criteria, title and lease review, property status, and credit assessment. A valuation alone does not guarantee loan approval.

Depending on the property's characteristics and available evidence, a commercial valuation may consider comparable sales, rental income, prevailing market yields, lease terms, occupancy, and relevant expenses. The adopted approach should fit the property's use and the purpose of the report.

Loan-to-value limits, eligible loan amounts, and acceptable valuation methods vary by lender and borrower profile. For a fee estimate, share the property's location, super area, ownership documents, and current lease details.

07 My HSVP plot does not have a conveyance deed. Can it still be valued or sold?

A valuation assessment may still be possible when an HSVP conveyance deed is pending, provided the available documents are sufficient to understand the property's identity, allotment history, possession status, and ownership interests. The report should clearly disclose any material documentation gaps.

Whether a transaction can proceed, and what documents or permissions are required, depends on the applicable HSVP conditions, title chain, transfer rules, and registration requirements. Do not assume that a sale can be completed solely on the basis of an allotment letter and possession certificate.

Before committing to a transaction, obtain a document review from a qualified property lawyer and check the current requirements with the relevant HSVP estate office and registration authority. Any effect on marketability should be assessed from the specific facts rather than applying a standard discount without supporting evidence.

08 The bank's valuer assessed my Gurugram flat below the agreed purchase price. What can I do?

Consider obtaining an independent property valuation to understand why the assessed value differs from the agreed price. A transaction price and a valuation figure may differ because of comparable evidence, property condition, title or occupancy status, the valuation date, or the purpose and assumptions of the assessment.

The independent review may examine relevant Gurugram comparable transactions, location and connectivity, building characteristics, lease or occupation status, and any supported market-specific factors. Each adjustment should be explained and supported by evidence.

You may submit the independent report and supporting documents to the bank and ask whether a review is possible. The lender retains discretion over its underwriting and final loan decision.
